These Terms of Service (“Terms”) govern your access to and use of the websites, content, and services of Apex Wellness Clinic (“Apex Wellness,” “we,” “us,” or “our”). By using our site or requesting services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

1. Who may use our services

You must be at least 18 years old and located in the United States — currently we serve patients in Tennessee, Florida, and Georgia. By using the site you represent that the information you provide is accurate and that you are legally able to enter into these Terms.

2. Our services

Apex Wellness offers functional wellness and hormone-focused laboratory testing, consultations with our clinical team, and personalized wellness planning. Laboratory draws are performed by third-party partners (such as LabCorp). We are a direct-pay practice and do not bill insurance; we can provide documentation you may submit to your insurer for possible reimbursement.

Our services support wellness and are not a substitute for emergency care or for the ongoing care of your primary or specialist physicians. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.

3. No medical advice through the website

Content on our website is provided for general informational and educational purposes only and does not constitute medical advice. Using the site or submitting a form does not create a provider–patient relationship. A clinical relationship is established only after you engage our services and complete the appropriate steps with a licensed clinician. Please also review our Medical Disclaimer.

4. Scheduling, payments, and cancellations

• Fees. Prices, packages, and promotional discounts are described at the time of purchase and may change. Applicable taxes and third-party lab fees may apply.
• Payment. Payment is due as described at checkout or before services are rendered, unless otherwise agreed in writing.

5. Your responsibilities

6. Intellectual property

The site and its content — including text, graphics, logos, images, and software — are owned by or licensed to Apex Wellness and are protected by intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission. The Apex Wellness name and logo are our trademarks.

7. Third-party services

We use third-party providers (for example, laboratory partners, scheduling and CRM platforms, and payment processors). Your use of those services may be subject to their own terms and policies. We are not responsible for the acts or omissions of third parties.

8. Disclaimers

The site and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any particular health outcome will be achieved. Individual results vary.

9. Limitation of liability

To the fullest extent permitted by law, Apex Wellness and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the site or services. Our total liability for any claim relating to the site or services will not exceed the amount you paid to us for the service giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify and hold harmless Apex Wellness from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the site or services or your violation of these Terms.

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules.
