Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Apex Wellness Clinic (“we,” “us,” or “our”) is required by law to maintain the privacy of your protected health information (“PHI”), to provide you with this Notice of our legal duties and privacy practices, to notify affected individuals following a breach of unsecured PHI, and to follow the terms of the Notice currently in effect.

How we may use and disclose your health information

We may use and disclose your PHI, without your written authorization, for the following purposes:

We may use your PHI to provide, coordinate, or manage your care — for example, sharing your lab results with the clinician reviewing them, or coordinating with the laboratory (such as LabCorp) that performs your testing.

Payment

We may use and disclose your PHI to obtain payment for services — for example, to prepare an invoice or documentation you may submit to your insurer for reimbursement.

Health care operations

We may use your PHI for operations such as quality improvement, staff training, scheduling, and business management.

Appointment reminders and communications

We may contact you to provide appointment reminders, test results, and information about treatment options or wellness services that may be of interest to you.

Business associates

We may share your PHI with third parties that perform services for us (for example, scheduling, records, or IT vendors) under written agreements that require them to safeguard your information.

We may use or disclose your PHI when required by law, and for public health and safety activities, health oversight, judicial and law-enforcement purposes, to avert a serious threat to health or safety, for workers’ compensation, and to coroners, medical examiners, or funeral directors, in each case as permitted by law.

A note on website advertising

Our marketing website uses advertising and analytics tools (described in our Privacy Policy). We do not use these tools to disclose your PHI for advertising without your authorization.

Our duties

We are required to maintain the privacy of your PHI, provide this Notice of our duties and privacy practices, follow the terms of the Notice currently in effect, and notify you following a breach of unsecured PHI. We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have as well as any information we receive in the future. Any revised Notice will be posted in our office and on our website.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer or with the U.S. Department of Health and Human Services, Office for Civil Rights, at hhs.gov/ocr. We will not retaliate against you for filing a complaint.
