Notice of Privacy Practices

Apex Wellness Clinic (“we,” “us,” or “our”) is required by law to maintain the privacy of your protected health information (“PHI”), to provide you with this Notice of our legal duties and privacy practices, to notify affected individuals following a breach of unsecured PHI, and to follow the terms of the Notice currently in effect.

How we may use and disclose your health information

We may use and disclose your PHI, without your written authorization, for the following purposes:

Treatment

We may use your PHI to provide, coordinate, or manage your care — for example, sharing your lab results with the clinician reviewing them, or coordinating with the laboratory (such as LabCorp) that performs your testing.

Payment

We may use and disclose your PHI to obtain payment for services — for example, to prepare an invoice or documentation you may submit to your insurer for reimbursement.

Health care operations

We may use your PHI for operations such as quality improvement, staff training, scheduling, and business management.

Appointment reminders and communications

We may contact you to provide appointment reminders, test results, and information about treatment options or wellness services that may be of interest to you.

Business associates

We may share your PHI with third parties that perform services for us (for example, scheduling, records, or IT vendors) under written agreements that require them to safeguard your information.

As required or permitted by law

We may use or disclose your PHI when required by law, and for public health and safety activities, health oversight, judicial and law-enforcement purposes, to avert a serious threat to health or safety, for workers’ compensation, and to coroners, medical examiners, or funeral directors, in each case as permitted by law.

Uses and disclosures that require your written authorization

Other uses and disclosures not described in this Notice will be made only with your written authorization. In particular, your authorization is required before we may:

• Use or disclose PHI for most marketing purposes;
• Sell your PHI; or
• Disclose psychotherapy notes (if any).

You may revoke an authorization in writing at any time, except to the extent we have already acted in reliance on it.

Your rights regarding your health information

• Right to access. You may inspect and obtain a copy of your PHI that we maintain, in the form and format you request when readily producible.
• Right to amend. You may request that we correct PHI you believe is inaccurate or incomplete. We may deny the request in certain cases and will explain why in writing.
• Right to an accounting of disclosures. You may request a list of certain disclosures we made of your PHI.
• Right to request restrictions. You may ask us to limit how we use or disclose your PHI. We are not required to agree, except that we must honor a request to restrict disclosure to a health plan for a service you paid for in full out of pocket.
• Right to confidential communications. You may ask us to communicate with you in a specific way or at a specific location.
• Right to a paper copy. You may obtain a paper copy of this Notice at any time, even if you agreed to receive it electronically.
• Right to breach notification. You have the right to be notified if there is a breach of your unsecured PHI.

Our duties

We are required to maintain the privacy of your PHI, provide this Notice of our duties and privacy practices, follow the terms of the Notice currently in effect, and notify you following a breach of unsecured PHI. We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have as well as any information we receive in the future. Any revised Notice will be posted in our office and on our website.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer or with the U.S. Department of Health and Human Services, Office for Civil Rights, at hhs.gov/ocr. We will not retaliate against you for filing a complaint.
